The Executive Order issued on February 28, 2024, titled “Preventing Access to Americans’ Bulk Sensitive Personal Data and United States Government-Related Data by Countries of Concern,” mandates that the Attorney General develop regulations that limit or prohibit U.S. persons from participating in any transactions that involve property in which a foreign country or its nationals have an interest. These transactions must meet specific criteria: they involve U.S. government-related data or large volumes of U.S. sensitive personal data as defined by the Order’s final rules, are identified by the Attorney General as posing a national security risk because they could allow access to this data by concerning countries or individuals, and conform to additional criteria set by the Order. This notice of proposed rulemaking calls for public feedback on topics pertinent to the Order’s implementation.
